Kelley M. Keller

Kelley M. Keller has enjoyed a varied commercial litigation practice, representing businesses and individuals involved in litigation ranging from antitrust, intellectual property, and energy-related litigation to fraud claims and contract disputes. Her primary area of practice has focused on class action, derivative, and securities litigation defense in state and federal court at both the trial and appellate level. She also has significant experience in NASD (now FINRA) and AAA arbitration matters. Before joining the firm, Ms. Keller practiced with the international firms of Skadden, Arps, Slate, Meagher & Flom, LLP and Vinson & Elkins.

Ms. Keller is a native Houstonian. She obtained her B.A. in Journalism from Texas A&M University in 1985. She received her Juris Doctor in 1989 from the University of Houston, where she was a member of the Order of Barons. Bar Admissions: State Courts of Texas, The United States District Courts for the Southern, Eastern, Western, and Northern Districts of Texas; The United States Court of Appeals for the Fifth Circuit.


Representative Litigation Has Included:

  • Obtained summary judgment for a defendant against a claim of fraud and breach of fiduciary duty in the purchase of plaintiff’s interest in an oil and gas company.
  • Obtained a dismissal with prejudice on behalf of an energy company in an action in federal court in which the plaintiffs alleged price manipulation under the Commodity Exchange Act.
  • Defended a financial services firm in numerous customer arbitrations.
  • Defended a physician’s practice group in a whistle-blower action in which the jury returned a verdict in favor of the group.
  • Defended officers and directors in direct and derivative litigation brought by shareholders in both state and federal court.
  • Successfully defeated class certification in actions brought by a consumer against a health products manufacturer and by a passenger against a cruise line.
  • Defended governmental entities in actions brought by private litigants asserting civil rights violations.
